Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of VerifAISkills ("Platform", "Service", "we", "us", "our"). By creating an account, sending invitations, or otherwise using the Platform, you ("User", "you") agree to be bound by these Terms.
If you do not agree, do not use the Platform.
Definitions
- Platform / Service
- VerifAISkills and the tools provided through it.
- User
- The person or organization creating an account, sending invitations, or otherwise using the Platform.
- Invitees
- Third parties invited to complete assessments.
1. Description of the Service
VerifAISkills provides tools that allow users to:
- Create and manage coding assessments
- Invite third parties ("Invitees") to complete assessments
- View assessment results and related analytics
The Platform provides technical tools only and does not:
- Make hiring, employment, academic, or qualification decisions
- Guarantee accuracy, fairness, or completeness of assessment results
- Replace professional judgment, interviews, or due diligence
2. User Responsibility & Decision-Making Disclaimer
You acknowledge and agree that:
- All evaluation, interpretation, and decision-making based on assessment results are solely your responsibility
- The Platform does not provide recommendations, endorsements, hiring advice, or suitability determinations
- Any decisions made based on results (including hiring, rejection, promotion, or academic outcomes) are made entirely at your own discretion and risk
- We shall not be liable for any outcomes, damages, or claims arising from your use of assessment results.
3. No Warranty on Assessment Results
Assessment results are provided "as is" and "as available."
We make no guarantees that:
- Results accurately reflect an individual's skills, abilities, or qualifications
- Assessments are free from errors, bias, or manipulation
- Invitees complete assessments independently or honestly
You are responsible for validating results through additional methods if required.
4. Invitations & Invitee Conduct
As the inviting user, you agree that:
- You are responsible for all invitations you send
- You have a legitimate purpose for inviting individuals
- You will not use the Platform for spam, harassment, or deceptive practices
- You will comply with all applicable employment, labor, and anti-discrimination laws
- You understand that Invitees are not your employees or contractors through the Platform.
5. Compliance With Laws (Employment & Anti-Discrimination)
You are solely responsible for ensuring that your use of the Platform complies with all applicable laws, including but not limited to:
- Employment and labor laws
- Anti-discrimination and equal opportunity laws
- Data protection and privacy laws
The Platform does not ensure compliance with jurisdiction-specific hiring or employment regulations.
6. Prohibited Uses
You may not:
- Reverse engineer or attempt to access Platform source code
- Use the Platform for unlawful or discriminatory purposes
- Misrepresent the Platform as making hiring or qualification decisions
- Attempt to manipulate, falsify, or exploit assessment results
- Upload malicious code or attempt unauthorized access
We reserve the right to suspend or terminate accounts for violations.
7. Intellectual Property
All Platform content, software, and branding are owned by or licensed to us.
You retain ownership of:
- Your assessment configurations
- Your evaluation criteria
By using the Platform, you grant us a limited license to process data solely to provide the Service.
8. Data & Privacy
Use of the Platform is also governed by our Privacy Policy.
You confirm that:
- You have a lawful basis to invite individuals and process their assessment data
- You are responsible for how you store, share, or act on assessment results outside the Platform
9. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, consequential, or special damages
- We are not responsible for lost profits, hiring decisions, reputational harm, or legal claims arising from your use of the Platform
- Our total liability shall not exceed the amount you paid us in the preceding 12 months (or $0 if free)
10. Indemnification
You agree to indemnify and hold harmless VerifAISkills, its founders, employees, and affiliates from any claims, damages, or expenses arising from:
- Your use of the Platform
- Your hiring or evaluation decisions
- Violations of laws or third-party rights
11. Account Termination
We may suspend or terminate your account at any time if:
- You violate these Terms
- You misuse the Platform
- Required by law or regulation
Upon termination, your access to the Platform will cease.
12. Modifications to the Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by the laws of your jurisdiction, without regard to conflict of law principles.
